In exercise of the powers conferred by Section 17 of the Births, Deaths and Other Personal Events (Registration) Act, 2033 (1976), Government of Nepal has framed the following Rules. 1. Short Title and Commencement: (1) These Rules may be called as "Births, Deaths and Other Personal Events (Registration) Rules, 2034 (1977)". (2) These Rules shall come into force immediately. 2. Definitions: Unless the subject or the context otherwise requires, in these Rules,- (a) "Act" means the Births, Deaths and Other Personal Events (Registration) Act, 2033 (1976). (b) "Informant" means the person with a duty to notify a personal event pursuant to the Act. 3. Functions and Duties of Registrar: In addition to the functions and duties mentioned elsewhere in these Rules, the functions and duties of the Registrar shall be as follows: (a) To give direction to the local registrars on registration of personal events, (b) To take necessary action on complaints made against the local registrars, accusing them of lingering the informants unnecessarily by not registering the personal events in due course of time or by not issuing the registration certificate, www.lawcommission.gov.np 2 To give permission to the local registrars on the correction of the details of a personal event already registered and alteration of a name already registered, (c) To specify the format of monthly statement of personal events registration to be forwarded by the office of the local registrar, (d) To give necessary suggestions to Government of Nepal on the statistics of personal events registration, (e) To prepare annual reports on personal events registration and submit to Government of Nepal, (f) To carry out necessary functions to fulfill the objective of the Act and the Rules in respect of registration of personal events. 4. Inventory of Family: (1) Government of Nepal may designate necessary employees to prepare an inventory of families for purposes of registering personal events and cause such employees to prepare the inventory of families in a format as referred to in Schedule-1. (2) The inventory of families prepared pursuant to Sub-rule (1) shall be maintained at the Registrar's Office and the concerned inventory of families shall be altered according to the monthly statements of personal events registration forwarded by the local registrars pursuant to Rule 13. 5. To Give Notice of Personal Events : (1) The informant shall give a notice of the following personal events to the local registrar's office in a format as referred to in the following schedules within the time-limitation as prescribed in the Act. Personal event Form (a) Birth Schedule - 2 (b) Death Schedule - 3 (c) Marriage Schedule - 4 (d) Divorce Schedule - 5 (e) Migration Schedule - 6 (2) If the name of a child is not yet been given at the time when the notice of the birth is given, the name of such a child may be registered later. (3) The forms referred to in Sub-rule (1) shall be provided to the informant at free of cost. 6. Registration of Personal Events : Upon receipt of a notice as referred to in Rule 5, the Local Registrar shall carry out the functions pursuant to the Act and register the notice of the following personal event in the register book as referred to in the following Schedule. www.lawcommission.gov.np 3 Personal event Register Book (a) Birth Schedule - 7 (b) Death Schedule - 8 (c) Marriage Schedule - 9 (d) Divorce Schedule - 10 (e) Migration Schedule - 11 7. Issuance of Registration Certificate: Upon a registration of a notice of personal event pursuant to Rule 6, the Local Registrar shall issue the registration certificate as referred to in the following Schedule to the informant of the following personal event. Personal event Registration certificate (a) Birth Schedule - 12 (b) Death Schedule - 13 (c) Marriage Schedule - 14 (d) Divorce Schedule - 15 (e) Migration Schedule - 16 8. Issuance of copy of Certificate: (1) If the personal event registration certificate is lost or destroyed in any manner, the concerned person shall submit an application to the local registrar's office for a copy of such a certificate. (2) Upon receipt of the application as referred to in Sub-rule (1), the local registrar shall issue a copy of the registration certificate bearing the date and signature, by mentioning the issuance of the copy of the registration certificate in the remarks column of the concerned Register Book and levying a fee of Five rupees. 9. Correction in Details: (1) If the details (particulars) of a registered personal event to be corrected for any reason, the concerned person shall submit an application, setting out such reason, accompanied by the concerned certificate, to the local registrar's office. (2) Upon receipt of the application as referred to in Sub-rule (1), the local register shall, with permission of the Registrar, make corrections as per the application in the concerned Register Book and in the certificate as well. The fee of one rupee shall be charged in correcting such registered details. 10. Registration of Child's Name and Alteration in Registered Name: (1) The concerned person shall submit an application, accompanied by the concerned certificate, to the local registrar's office for registration of the name of a child pursuant to Sub-rule (2) of Rule 5. www.lawcommission.gov.np 4 (2) Upon receipt of the application as referred to in Sub-rule (1), the local registrar shall register the name as mentioned in the application in the concerned Register Book and also mention the name in the certificate, and also indicate date and sign therein. (3) The local registrar shall give information of the name registration pursuant to Sub-rule (2) to the Registrar's Office immediately. (4) If the already registered name of any person is to be altered, the concerned person shall submit an application, setting out the reason therefor, accompanied by the concerned certificate, to the concerned local registrar's office. (5) Upon receipt of the application referred to in Sub-rule (4), the local registrar shall, with the permission of the Registrar, write down the altered name in the remarks column of the concerned Register Book with date and signature and also in the certificate. The fee of One Rupee shall be charged in so altering the already registered name. 11. Inspection of Register Book: If the concerned person submits an application for inspection of the personal events Register Book, the local registrar may allow that person to inspect the Register Book in his/her presence by levying the inspection fee of One Rupee. 111A. Fees to be deposited in the Fund: (1) The fees and other amount pursuant to the Act and these Rules except the fine to be received pursuant to Section 13 of the Act shall be deposited in the fund of the Village Development Committee or Municipality. (2) The amount deposited pursuant to Sub-rule (1) shall be expended in the personal event registration activities. 12. Making Application: (1) If the concerned person is unable to read and write, in submitting an application pursuant to the Act and the Rules, the local registrar shall him/herself write down or get any one to write down the matter as stated by the concerned person and get that person to set thumb impressions. (2) No fee shall be charged in making application pursuant to this Act or these Rules. 13. Forwarding Monthly Statement: The local registrar's office shall forward monthly statements of the personal events registration in the format as prescribed 1 Inserted by the First Amendment. www.lawcommission.gov.np 5 by the Registrar's Office to the Registrar's Office within the first week of the next month. 14. Maintaining Records: The Registrar's Office shall collect and analyse the details obtained pursuant to Rule 13 and maintain updated records of personal events registration. 15. Alteration in Schedule: Government of Nepal may, by a Notification published in Nepal Gazette, make alterations in the Schedules as per necessity.
